This Privacy Policy explains how we collect, use, disclose, and protect information when you use the jakd mobile application, related websites, and services (collectively, the "Service").

1) Scope

This Policy applies to information collected through the Service. It does not apply to third-party sites or services you access through the Service (e.g., Apple, Google, RevenueCat, analytics providers), which have their own privacy policies.

2) Information We Collect

2.1 Information You Provide

  • Account info: name, email, username, profile photo, password (or authentication token), preferences
  • Fitness inputs: goals, workout plans, logged exercises, sets/reps, notes, progress metrics you enter
  • UGC and social activity: posts, comments, reactions, messages (if enabled), reports you submit
  • Support: customer support messages and attachments

2.2 Information Collected Automatically

  • Device/app info: device model, OS version, app version, language, time zone, device identifiers (as permitted), network info
  • Usage data: feature usage, screens viewed, taps/interactions, session duration, referral/source
  • Diagnostics: crash logs, performance data, error reports
  • Approximate location: derived from IP address (city/region only)

2.3 Precise Location (If Enabled)

If the Service requests precise GPS location, we will ask for permission first. You can deny or revoke at any time in device settings.

2.4 Camera, Photos, and Media (If Enabled)

If you use features that require camera/photos (e.g., uploading form videos or images), we will request permission. Media you upload may be stored and processed to provide the feature.

2.5 AI Features Data

If you use AI Features (e.g., AI Spotter), we may process:

  • Inputs you provide (text prompts, workout context, and—if enabled—images/video)
  • Outputs generated by the AI Feature
  • Feedback you provide (likes/dislikes, corrections), if available

AI Features are powered by third-party language model providers. Your inputs and conversation history may be sent to these providers to generate responses. We do not permit our AI providers to use your data to train their models. See Section 6 for more details.

2.6 Health and Fitness Integrations (If Used)

If you integrate with Apple HealthKit, Google Health Connect, or similar services, we collect only the data types you explicitly authorize. You can revoke access at any time through your device settings.

Apple HealthKit Notice:

  • Data obtained through HealthKit is used solely to provide health and fitness features within the Service (e.g., syncing workout data, displaying activity metrics).
  • HealthKit data will not be used for advertising, marketing, or data-mining purposes.
  • HealthKit data will not be sold, shared with, or disclosed to third parties, including advertising platforms, data brokers, or information resellers.
  • HealthKit data will not be used for purposes unrelated to providing health and fitness functionality within the Service.

2.7 Subscription and Purchase Information (Apple/Google; RevenueCat)

Payments are processed by Apple/Google. We may receive:

  • Subscription status and entitlement info (active/inactive, product IDs)
  • Purchase/renewal events, timestamps, and country/region (as provided)

We do not receive your full payment card number.

3) How We Use Information

We use information to:

  • Provide, operate, and maintain the Service and your Account
  • Enable subscriptions and entitlement management (including through RevenueCat)
  • Personalize training experiences and recommendations
  • Provide AI Features and improve quality, safety, and reliability
  • Moderate UGC, enforce rules, and prevent abuse/fraud
  • Communicate with you about updates, security, and support
  • Analyze and improve performance, debugging, and product development
  • Comply with legal obligations and enforce Terms

4) How We Disclose Information

4.1 Service Providers (Processors)

We share information with vendors who help run the Service, including hosting and infrastructure, analytics and crash reporting, subscription management (RevenueCat), AI model providers, and customer support tools. These providers process information under data processing agreements that restrict how they may use your data.

4.2 App Stores and Platform Providers

Apple/Google process payments and may provide subscription signals/entitlements to us directly or via RevenueCat.

4.3 Other Users (Social Features)

If you post publicly, other users may see your profile and User Content. Your privacy settings (if any) control visibility.

4.4 Legal, Safety, and Enforcement

We may disclose information if required by law, subpoena, court order, or if we believe disclosure is necessary to protect rights, safety, investigate fraud, or enforce Terms.

4.5 Business Transfers

If we're involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

5) Cookies / Tracking (App Context)

Mobile apps typically use SDKs rather than browser cookies. We may use identifiers and SDKs for analytics, crash reporting, fraud prevention, and subscription validation. You can limit certain tracking through device settings (e.g., iOS "Allow Apps to Request to Track") where applicable.

We do not knowingly sell personal information. We do not share personal information for cross-context behavioral advertising. We honor Global Privacy Control (GPC) signals where required by applicable law.

6) AI and Automated Processing

AI Features may produce inaccurate outputs and are for informational/entertainment purposes only. AI outputs are not reviewed by a certified personal trainer, coach, or medical professional. We may use AI Feature interactions to:

  • Provide the feature and generate responses,
  • Detect abuse and enforce safety,
  • Improve model performance and reduce harmful outputs.

AI Data Sharing:

To provide AI Features, your inputs (prompts, workout context) and conversation history are sent to third-party AI model providers for processing. We contractually prohibit these providers from using your data to train their general-purpose models. We do not use your AI conversations to train third-party models. De-identified and aggregated data may be used to improve the Service.

No automated decision-making with legal or similarly significant effects is intended.

7) Data Retention

We retain information as long as reasonably necessary to:

  • Provide the Service and maintain your Account,
  • Comply with legal obligations,
  • Resolve disputes,
  • Enforce agreements,
  • Maintain security and prevent abuse.

Retention examples:

  • Account data: retained until deletion request + reasonable processing period
  • Logs/diagnostics: retained for a limited period for security and debugging
  • UGC: retained until removed by you or moderated/removed by us, unless legally required to keep longer

We may de-identify or aggregate information and retain it for analytics and improvement.

8) Security

We use reasonable administrative, technical, and organizational safeguards to protect information. No method of transmission/storage is 100% secure; you use the Service at your own risk.

9) Your Choices and Rights

9.1 Account Controls

You may update profile info and preferences in-app.

9.2 Permissions

You can grant/deny/revoke permissions (camera, photos, location, HealthKit/Google Health Connect) in device settings.

9.3 Marketing Communications (If Any)

If we send marketing emails, you can opt out via the unsubscribe link or by contacting us.

9.4 Deleting Your Account

You may request account deletion by contacting support@jakd.app. We will process deletion requests within 30 days, subject to legal retention requirements. Some information may be retained as required by law or for legitimate security purposes.

10) U.S. State Privacy Rights

Depending on where you live (e.g., California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with privacy laws), you may have rights to:

  • Access or confirm processing of personal data
  • Correct inaccurate data
  • Delete personal data (subject to exceptions)
  • Obtain a copy of data (portability)
  • Opt out of certain processing (e.g., targeted advertising, profiling, "sale" if applicable)

To exercise rights, contact josh@jakd.app. We will respond within the timeframe required by your applicable state law (typically 45 days). We may verify your identity before processing your request. Authorized agents may be required to provide proof of authorization. We will not discriminate against you for exercising your rights.

California notice (CCPA/CPRA):

We do not "sell" personal information as defined under the CCPA/CPRA. We do not "share" personal information for cross-context behavioral advertising. We honor the Global Privacy Control (GPC) signal as a valid opt-out request where required by California law.

Sensitive data notice:

Some state privacy laws classify health and fitness data as "sensitive data." We process fitness-related data solely to provide the Service (workout tracking, progress analytics, AI coaching). We do not use sensitive data for advertising or profiling purposes.

11) Children's Privacy

The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete the information and terminate the associated account as soon as reasonably practicable.

If you believe a child under 13 has provided us with personal information, please contact us immediately at josh@jakd.app so we can take appropriate action.

12) International Users

The Service is operated from the United States. If you access the Service from outside the U.S., your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from your jurisdiction. By using the Service, you consent to this transfer. If you are located in the European Economic Area, United Kingdom, or Switzerland, please be aware that U.S. data protection laws may not provide the same level of protection as your local laws.

13) Third-Party Links and Services

The Service may link to or integrate with third-party services. This Policy does not apply to those third parties. Review their policies before providing them with information.

14) Changes to This Policy

We may update this Policy from time to time. We will post the updated version and update the Effective Date. For material changes, we will provide notice through the Service (e.g., an in-app notification or prominent notice on our website) at least 30 days before the changes take effect, where required by law.
